Removal of the judge responsible for the case – Guarantee of impartiality and defence of the public interest

26 November marked a decisive moment in the defence of Quinta dos Ingleses. During the court hearing, relevant information came to light regarding the judge currently responsible for the case, Dr José Conde Rodrigues, namely his past (which includes a conviction for embezzlement, later overturned on appeal) which, combined with the decisions he has taken in the Quinta dos Ingleses case, raises doubts about his independence and impartiality.

In light of these facts, and with the aim of ensuring transparency, impartiality and the integrity of the entire procedure, our lawyer submitted a formal request for recusal. The submission, solid and rigorously substantiated, demonstrated the existence of objective reasons to suspect the magistrate’s neutrality.

Following this request, the court decided to suspend the trial. This decision will allow the proceedings to continue under the responsibility of another magistrate whose impartiality is not in question.

This outcome represents a significant victory not only for our association, but for all those who believe in the importance of a justice system that is upright, transparent and free from undue influence. The defence of Quinta dos Ingleses continues stronger than ever and protected by a fair legal framework.
